Terms and Conditions

These terms and conditions (the "Terms and Conditions") govern the use of tvtv.us and tvtv.ca (the "Sites"). The Sites are owned and operated by LocalTvTv Inc. The Sites are tv guides.

By using the Sites, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times. You are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the Sites. The materials contained in the Sites are protected by applicable copyright and trademark law.

Intellectual Property

All content published and made available on the Sites is the property of LocalTvTv Inc. and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of the Sites. Permission is granted to view the materials (information or software) on the Sites for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

1. modify or copy the materials;
2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
3. attempt to decompile or reverse engineer any software contained on LocalTvTv Inc.'s website;
4. remove any copyright or other proprietary notations from the materials;
5. transfer the materials to another person or "mirror" the materials on any other server;
6. use an Ad blocker.

Accounts

When you create an account on the Sites, you agree to the following:

1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using the Sites illegally or if you violate these Terms and Conditions. Upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Third Party Goods and Services

The Sites may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on the Sites.

Links to Other Websites

The Sites contain links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on the Sites. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using third party websites.

Access to services

LocalTvTv Inc. reserves the right to remove any/all 3rd party integrations or features or access.

Feedback

You may choose to submit feedback, ideas and suggestions about the Sites, but it is never required. You agree that we may use and share all feedback, ideas, and suggestions you submit for any purpose and without compensation or obligation to you. We may use any feedback, ideas, or suggestions you give us without payment or any type of obligation to you.

Subscriptions

Types of users and level of access

The Services and Content (as defined below) may contain materials that are not suitable for minors. You acknowledge that you are fully responsible for the conduct and use of the Services and Content by minors in your care and control whom you have authorized to access and use the Services and Content.

• Subscribers: have created a registration account and pay fees for an ad free service with access to features/enhancements as they are released.
• Non-Subscribers: have free access to our Sites with ads.
• Use of ad blockers: is prohibited. Content on our Sites will be unavailable.

Subscribing to a service

LocalTvTv Inc. reserves the right to reject or cancel a subscription for a Service at any time.

Subscription agreement

Certain Services and Content will only be provided to you upon your acceptance of a Subscription Agreement with LocalTvTv Inc. A link to the Subscription Agreement will be presented to you for your review during the subscription process. Information provided by you to fulfil a subscription order is subject to LocalTvTv Inc.’s Privacy Policy.

Fees

• LocalTvTv Inc. reserves the right to charge fees for access to any Service.
• You will not be charged a fee for a Service unless you subscribe to that Service. You must be of the age of majority in your jurisdiction of residence to subscribe to a Service.
• The fees for Service (plus any applicable taxes or other additional charges, such as administration, transaction or access fees), accepted methods of payment and accepted frequencies of billing (monthly) will be specified at the time of subscription. All fees are in TVTV.us (United States dollars) TVTV.ca (Canadian dollars).
• For subscriptions to Services, you will be automatically billed (i.e. charged or debited) monthly, in accordance with the billing cycle selected at the time of purchase.
• You are responsible for providing and maintaining current, complete and accurate billing and delivery information.
• You are responsible for reading and adhering to our 3rd party payment partner Stripe’s Terms of Service and Privacy Policy.

By subscribing to a Service, you agree to pay the subscription fees specified at the time of purchase, using the method of payment chosen, and billed/charged at the frequency provided.

Term

If you purchase a periodic subscription to a Service, your subscription will continue until it is canceled.

Modifications by LocalTvTv Inc.

You will be given advance notice of any new fees, changes to current fees or other material changes to the Services by posting on https://LocalTvTv.info If you do not wish to accept the new fees, you may cancel your Service in accordance with these Terms and Conditions or an applicable Subscription Agreement. If LocalTvTv Inc. has made, in its sole determination, an error in fees for a Service, your sole remedy is to cancel the Service. LocalTvTv Inc. is under no obligation to provide you with the Service at the erroneous fee.

Cancellations and refunds

• No refunds will be provided for the month in which the cancellation occurs. The billing will cease to occur in the following month after cancellation.
• No refunds will be provided for short term loss of service or data.

Disclaimer

1. The materials on the Sites are provided on an 'as is' basis. LocalTvTv Inc. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
2. Further, LocalTvTv Inc. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Sites or otherwise relating to such materials or on any sites linked to the Sites. The materials appearing on the Sites could include technical, typographical, or photographic errors. LocalTvTv Inc. does not warrant that any of the materials on the Sites are accurate, complete or current. LocalTvTv Inc. may make changes to the materials contained on the Sites at any time without notice. However LocalTvTv Inc. does not make any commitment to update the materials.
3. LocalTvTv Inc. is not responsible for the quality or capability of your equipment, signal strength, or bandwidth.
4. LocalTvTv Inc. has no responsibility and cannot affect or control the service provided by any TV service provider or station.
5. LocalTVTV Inc. warrants a best effort for website viewability. On very rare occasions, the website may become unavailable or the data will be unavailable due to unforeseen circumstances. LocalTvTv Inc. will ensure that the site is back as soon as possible.

Limitation of Liability

LocalTvTv Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Sites. In no event shall LocalTvTv Inc. or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the Sites, even if LocalTvTv Inc. or a LocalTvTv Inc. authorized representative has been notified orally or in writing of the possibility of such damage. Some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages. These limitations may not apply.

Indemnity

Except where prohibited by law, by using the Sites you indemnify and hold harmless LocalTvTv Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of the Sites or your violation of these Terms and Conditions.

Applicable Law

These terms and conditions are governed by and construed in accordance with the laws of Ontario, Canada and you irrevocably submit to the exclusive jurisdiction of the courts in that state or location.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate the Sites and the way we expect users to behave on the Sites. We will notify users by email of changes to these Terms and Conditions or post a notice on the Sites.
